TERMS AND CONDITIONS OF USE OF SERVICES

1.1 These Terms and Conditions of Use are applicable to the use of services offered by SNOG SERVICOS DE INFORMATICA LTDA, a limited company registered with the CNPJ under no. 46.381.358/0001-02, with registered office at Avenida das Nações Unidas, 14401, Conjunto 1304 Taruma building, São Paulo, CEP: 04794-000, hereinafter referred to as “SNOG”, which provides scheduling of bus tickets and other travel-related services through the website

www.snog.com.br, WhatsApp at 55 (11) 5039-8333, apps for Android and iOS and through any other marketing channel that has a partnership with SNOG to offer travel services.

1.2 This term is strictly validated in accordance with the consumer protection code (Law 8,078/90) and Decree 7,962/2013. Any legally capable person, called USER, who uses SNOG services, must accept this Terms of Use and all policies and principles that regulate it.

1.3 THE TERMS OF USE IS INDISPENSABLE, being mandatory for the USE of the services offered by SNOG. The use of the services offered by SNOG implies immediate acquiescence/consent to this Term and its content. This agreement constitutes an exclusive document between SNOG and the USER, thus replacing all previous agreements, representations, warranties and understandings with respect to SNOG, its contents and services provided.


2. WHEREAS:

2.1 SNOG only provides the service of facilitating the purchase of tickets, does not carry out trips and/or has no direct relationship with AUTO VIAÇÕES, registered on our platforms;

2.2 Partner companies called AUTO VIAÇÔES are companies that provide road transport services, previously registered and authorized by SNOG, defined on the main page of the domain owned by SNOG and also available for consultation on the WhatsApp channel. AUTO VIAÇÕES assumes all responsibility for any damage arising from the issuance of the ticket at the bus terminal counters.


ATTENTION:

The CUSTOMER agrees that SNOG has no responsibility for the issuance of the ticket at the bus terminal counters, whether, but not limited to, incorrect ticket issuance, damage/loss of luggage, route accidents, route deviations and /or any other damage for which SNOG does not act directly.


3. TERMS AND CONDITIONS OF USE

IMPORTANT: “Customers” under 18 years of age will only be able to register or register on the channels made available by SNOG as long as they are duly represented or assisted, as provided for in the Arts. 1,634 and 1,690 of the civil code, by their representatives or legal assistants, who must be responsible in the civil sphere for any and all acts carried out by the minor when using SNOG's channels and marketplace sales platform. Legal representatives will be responsible for any and all illegal acts committed by the minor when using SNOG channels and marketplace.

3.1 When completing the order and paying for the order generated from the solutions made available by SNOG mentioned in item 1.1 of this document, the USER automatically agrees to the Terms and Conditions of Use explained here. If the USER does not agree with the Terms and Conditions of Use, they should not make any type of purchase in the solutions provided by SNOG.

3.2 The use of the online Services made available by SNOG by any user will imply express acceptance of these Terms and Conditions of Use.

3.3 The TERMS OF USE are an integral part of all services provided by SNOG and are intended to clarify and define the rules and conditions that will guide the use of the services offered by the company.

When using SNOG electronic platforms, the USER automatically declares to have read and fully agrees with these TERMS OF USE, to which they adhere and agree to be bound.

3.4 SNOG does not guarantee that its content is appropriate or available for use in other locations outside Brazilian territory; also disclaims responsibility for access to SNOG channels from territories where their content is illegal, with the entire burden of use falling on the USER.

3.5 SNOG does not own or have any ownership interest in the companies that sell tickets through its platform (AUTO VIAÇÕES).

3.6 SNOG is not responsible for any changes to the itinerary that may be requested by AUTO VIAÇÃO, such as delays in departure or arrival, changes to the original route or cancellation of the trip; nor for accidents or injuries occurring during transport, loss or damage caused to the USER's luggage, or all other incidents occurring in the activities under the responsibility of AUTO VIAÇÃO.

3.7 In cases where the USER or any third party initiates any type of complaint or legal action against any of the transport companies that use the SNOG platform, each and every USER involved in the complaints or actions exempts SNOG and the its directors, managers, employees, agents, workers, representatives and attorneys regarding any defect caused in the provision of AUTO VIAÇÃO services.

3.8 Information about the services will be made available and organized on SNOG channels in a clear, precise manner and in Portuguese, including all information regarding the types of tickets and reservations available.

3.9 The acquisition of the service(s) by the USER will be finalized and completed, after due payment, which will be made through the provision of services from a company responsible for payment management. SNOG will not be able to intervene in the results of the USER's relationship with the company responsible for managing payments, as it manages its operations independently.

3.10 SNOG cannot guarantee in any way that the services provided by the company responsible for managing payments will operate free of errors, interruptions, malfunctions, delays or other imperfections. It should be noted that it will not be responsible for the availability or otherwise of the Services provided by the company responsible for managing payments or for the impossibility of using the Service.

3.11 SNOG may, at any time, change this instrument with a view to improving, as well as improving the services provided. The new contractual instrument will come into force, without prejudice to the services provided under the previous contract. Therefore, SNOG recommends that the USER carefully re-read the terms and conditions of use whenever accessing the Website, WhatsApp, other channels mentioned in item 1.1 or carrying out any operation through them.

3.12 SNOG will take all possible measures to maintain confidentiality, security and secrecy regarding USER information, but will not be liable for losses that may arise from the violation of these measures by third parties using public networks or the internet, subverting the security systems to access USER information.

3.13 SNOG will not be responsible for any damage, loss or loss to the USER's equipment caused by failures in the system, server or internet resulting from the conduct of third parties, except that eventually, the system may not be available for technical reasons or failures of the internet, or any other fortuitous event or force majeure beyond its control.

3.14 In cases where the USER or any third party initiates any type of complaint or legal action against any of the transport companies that use the SNOG platform, each and every USER involved in the complaints or actions exempts SNOG and the its directors, managers, employees, agents, workers, representatives and attorneys regarding any defect caused in the provision of AUTO VIAÇÃO services.


4. PRIVACY and DATA SECURITY

4.1 The USER's registration data and access information will only be used by SNOG to improve the browsing experience, improve the provision of services to its customers and to achieve its business objectives.

4.2 USERS' registration data and access information will not be provided to third parties, except in the event that the data is provided by court order.

4.3 The USER will be responsible for the veracity and updating, in case of changes, of the data provided, under penalty of being subject to applicable legal sanctions.

4.4 The USER undertakes to inform SNOG immediately if he becomes aware of unauthorized use of his account, or access to the account by unauthorized third parties.

4.5 SNOG makes every effort to maintain the security and confidentiality of USER information, not being responsible, however, for any losses that may arise from the violation of these measures by third parties using public networks or the internet, subverting security systems to access USER information.

4.6 In fact, concerned about the security and privacy of the data that passes through SNOG's solutions, SNOG declares that the access password and all data that the USER enters are protected. SNOG recommends that the USER never provide their password to third parties. The USER is fully responsible for the confidentiality and use of their password and identity.

4.7. In accordance with the protective legislation of the Consumer Protection Code and the specific legislation of ANTT, the USER is guaranteed the right to regret and cancel tickets, as long as the rules established in clause 13 (CHANGES AND CANCELLATIONS OF TICKETS) of this term are respected.

4.8. SNOG reserves the right to offer exclusive and limited promotions/vouchers to selected customers, and AUTO VIAÇÕES is not responsible for these promotions nor for guaranteeing the same promotional value in any other situation.


5. OBJECT OF THE CONTRACT

5.1 The purpose of this contract is to facilitate, through SNOG's own tool, purchases of road tickets by USERS.


6. INFORMATION FOR THE USE OF THE SERVICES

6.1 USER REGISTRATION

6.1.1 It is an essential condition for the USER to register to purchase the desired ticket, simply follow the step-by-step instructions when first accessing the solutions offered by SNOG

6.1.2 The USER must inform the name, CPF, email address and telephone number, and the telephone number can also be captured at the time of registration on any SNOG solutions channel and stored in the customer's registration, without the need to enter the USER. This data will be our contact method as a USER. It is the USER's duty to check the data provided, ensuring that they are correct and to remain attentive to the information that will be sent.

6.1.3 The USER will not be allowed to have more than one registration and, if this occurs, SNOG will automatically, after verifying the data, definitively disable all registrations.

6.1.4 Any and all USERS under the age of 18 must obtain the express consent of their parents or legal representatives before providing their email addresses or any data through the channels mentioned in item 1.1. All information provided by the USER must be accurate, precise and true, and duly updated, should any changes occur, the USER further acknowledging that SNOG has no obligation to verify the accuracy of the data transmitted by the USER or any other person.

6.1.5 In view of this, SNOG will not be responsible for the correction of personal data entered by the USER, being certain that the USER or their parents or legal representatives, when applicable – guarantees and responds, in any case, for the veracity, accuracy and authenticity of registered personal data.

6.1.6. SNOG undertakes not to transfer or sell, in any way, individual information of the registered USER without their express authorization. However, the USER agrees that the Internet, as a worldwide computer network to which anyone can have access, is not a completely secure medium. In the case of using SNOG channels, companies will not be responsible under any circumstances for losses of any kind, including, but not limited to, those resulting from the use of such data by third parties or loss of registered USER data, arising directly or indirectly your access or navigation on SNOG channels.

6.1.7. SNOG, at its sole and absolute discretion, may change the qualification criteria and/or requirements for maintaining registrants. In this way, SNOG may immediately terminate the registration of the registered person, regardless of the payment of a fine and/or compensation, in any capacity, to the USER, subsequently stating the justification or reasons.

6.1.8. The USER's right to rectify any data sent to SNOG is reserved. However, the USER's right to rectification will not impede or replace SNOG's right to claim appropriate compensation, in the event of erroneous information causing any damage and/or losses to the company or third parties, in the period prior to its rectification by the USER.


7. STEPS TO PURCHASE A TICKET

7.1 Initially, the USER will have to register in advance, which will only be requested upon first access and will not be necessary for future purchases;

7.2 After registering, simply type or select the city of origin, destination and travel date;

7.3 After filling in the initial data, the USER must choose one of the options available for the stretch, according to times and prices available at the time of purchase;

7.4. From seat reservation:

7.4.1. The USER will be able to reserve their seat, however SNOG is not responsible for the inaccuracy of the data entered when reserving a seat. USERS are aware of the veracity, accuracy and authenticity of the personal data registered.

7.4.2. Seats are only reserved when payment is completed, if payment is not made, the ticket will be released for sale again and the seat can be reserved by another USER.

7.4.3. The ticket must be in the name of the passenger who will travel so that he or she, in possession of his or her document, can collect it at the company counter.

7.4.4 Your seat number may be changed in the purchase confirmation, when the seat is occupied by another passenger before your payment is approved or identified. If the seat issuance process also fails with the bus company, SNOG reissues the seat with another number to ensure your boarding on the desired itinerary.

7.5 Once the search criteria are met, the platform will indicate to the USER the tickets available for the selected date and time, with a breakdown of the AUTO VIAÇÃO responsible, the value of the tickets and the FEES AND CHARGES, among other information available on the query page.

7.6 The voucher is not a sufficient document to board the bus and travel. In some cases it is necessary to collect the ticket from AUTO VIAÇÃO.

7.7 All order information and updates will be sent directly to the USER's email and WhatsApp, informed by them at the time of registration, and it is their responsibility to receive and read the communications sent.

7.8. When filling in the passenger data:

7.8.1. The USER must fill in their details correctly to issue the ticket, to validate the purchase by the card operator, SNOG's internal team and the anti-fraud team.

7.8.2. SNOG is not responsible for incorrectly filling out the required information, as well as for the USER's non-approval after evaluating the requested documentation.


8. FEES AND PAYMENT METHODS:

8.1. Charging the convenience fee

8.1.1. To provide a service to facilitate the purchase of bus tickets, the company SNOG, which produces and manages the website, may charge a convenience fee. The convenience fee, if any, will be detailed at the time of purchase, clearly and without intervention by AUTO AVIAÇÕES.

8.1.2. All transactions carried out have additional fees charged.

8.1.3. The convenience fee that may be charged by SNOG, at the time of purchasing the ticket, for providing the service, will not be returned to the USER as it is a service already provided to the USER.

8.1.4 Fees and charges are not to be confused with, but will be added to the value of the ticket at the time of payment.


IMPORTANT: All fees and charges for services are informed and detailed during the purchase process, both for Brazilians and foreigners. By accepting the TERMS OF USE and proceeding with the purchase, the customer declares that they are aware of the amounts charged and will not be able to question them.

8.1.5 As this is an intermediary provision of bus ticket sales services, the invoice relating to the SNOG service will be issued in the exact value of their respective fees and charges, without considering the value of the tickets, whose tax documentation remains borne by the respective AUTO VIAÇÕES.

8.2 The promotions and discounts offered by the company are established for a limited time, with SNOG not being held liable for any unsuccessful acquisition if there is an error during the operation, payment is not approved, promotional seats are exhausted or if the duration of the promotion reaches at its end.

8.3. For tickets in installments, the convenience fee, if any, may change according to the number of installments.

8.4. Payment methods:

8.4.1. credit card

8.4.1.1. SNOG accepts the main credit card brands: VISA, MASTERCARD, AMERICAN EXPRESS, ELO, HIPERCARD and DINERS. SNOG will charge your credit card immediately upon receipt of your order.

8.4.2. PIX

8.4.2.1. SNOG offers the Pix option to pay for bus tickets safely. The solution is a partnership with SNOG and REPASSES FINANCEIROS E SOLUCOES TECNOLOGICAS INSTITUICAO DE PAGAMENTO, secure technology for cash payment solutions, aiming to meet the demand for online purchases without a credit card.


IMPORTANT: ALL FEES WILL BE INFORMED AND DISCRIMINED ON THE PURCHASE COMPLETION SCREEN. BY CLICKING ON THE PAYMENT TYPE BUTTON, THE CUSTOMER DECLARES TO BE AWARE OF THE AMOUNT CHARGED AND WILL NOT BE ABLE TO QUESTION THEM.


IMPORTANT: SNOG RESERVES THE RIGHT TO EXCLUDE ANY PAYMENT METHOD AND TO USE OTHER PAYMENT METHODS ON THE MARKET.

    ROAD TICKET PRINTING:9.1. Upon completion of the purchase, the USER will receive payment confirmation and a summary of the order via WhatsApp, containing details about the trip.9.2. To print your ticket, go to the AUTO VIAÇÃO counter 1 (one) hour before boarding time, with the original document with photo filled out when reserving your seats. Certified copies will not be accepted.


10. TICKETS CHANGES AND CANCELLATIONS:

10.1 The USER is guaranteed to request a change in the boarding date or time, directly at the AUTO VIAÇÃO counter, by telephone or in person at least 5 (five) hours in advance of the established boarding time.

10.2. The time transfer will be subject to the availability of tickets on the date and time desired by the USER, with the USER also being guaranteed the option of a ticket with an open date and time, with a maximum validity of 12 (twelve) months, counting from the date of purchase of the ticket. original ticket, subject to price adjustment. Contact the bus company directly, by phone or at the counter inside the bus terminal.

EXCEPTIONS: Some companies available for purchase on the channels only operate on intercity routes, and, therefore, do not need to adhere to ANTT standards. In these cases, the exchange terms after the travel date mentioned above do not apply.

Therefore, due to specific State Laws, the deadlines for canceling tickets may be changed.


Important: The State of Minas Gerais, through State Law 13,655/2000 and Decree 44,603/2007, stipulates a minimum period of 12 hours before boarding for the passenger to cancel and be entitled to a refund or reschedule their ticket. For interstate and international transport, the deadlines stated in these Terms of Use remain in accordance with clause 13.1 et seq.

10.3. If your ticket is canceled, it can be done in the following ways:

The USER may request the cancellation of the ticket purchase from the channel that made the purchase. If so desired, the USER may cancel online at least 4 hours in advance or directly with AUTO VIAÇÃO up to 3 hours in advance for interstate trips. The rules for changing and canceling intercity trips vary depending on the state and vehicle in question. Cancellation requests will only be accepted online directly in the CUSTOMER area, cancellation requests by email or telephone will not be accepted.

10.3.1. Through SNOG through our online call center, within the SNOG team's opening hours. SNOG's customer service is open from 8am to 8pm from Monday to Friday. Saturday, Sunday and holidays from 9am to 6pm.

10.3.2. In person through the ticket office of the Transport Company responsible for your trip, and must be requested up to 3 (three) hours in advance of your trip.


11. TICKET REFUND:

11.1. Credit card:

11.1.1. The refund of the amount will be in accordance with the transfer from the brand administrator.

11.1.2. The amount will be credited on the next due date of the USER's invoice, which may occur from 30 (thirty) to 60 (sixty) days.

11.2. PIX

11.2.1. The refund of amounts will be made directly to the bank account through which the USER made the Pix within 3 (three) days after the cancellation request.


IMPORTANT: UNDER THE TERMS OF ART.8, §2 OF ANTT RESOLUTION No. 978, THE CARRIER IS AUTHORIZED TO WITHHOLD UP TO 5% (FIVE PERCENT) OF THE AMOUNT PAID FOR THE ROAD TICKET, AS A COMPENSATORY FINE, IN THE EVENT OF THE PASSENGER MAKES THE CANCELLATION OR TRANSFER, WITHIN THE PERIOD SET FORTH IN THE CAPPUT OF THIS CLAUSE.

IMPORTANT: THE CONVENIENCE FEE THAT MAY BE CHARGED BY “SNOG” FOR PERFORMING THE SERVICES WILL NOT BE REFUNDED, AS IT IS A SERVICE PROVIDED ALREADY PERFORMED TO THE “CUSTOMER”.


12. LUGGAGE TRANSPORTATION

12.1 Luggage transportation must comply with ANTT provisions and must be handled directly with AUTO VIAÇÃO, responsible for this service.

12.2 Luggage rack with thirty kilos of total weight and a maximum volume of three hundred cubic centimeters, is limited to the largest dimension of any volume to one meter and in the package holder, five kilos of total weight, with dimensions that adapt to the location, as long as the comfort, safety and hygiene of passengers are not jeopardized;

12.3 It is prohibited to transport products considered dangerous, indicated in specific legislation, as well as those that, by their shape or nature, compromise the safety of the vehicle, its occupants or third parties, in accordance with art.72 of Decree 2521/98 .


    ANIMAL TRANSPORTATION

13.1 The transport of domestic and wild animals is at the discretion of the AUTO VIAÇÕES responsible for the transport, and the USER is responsible for consulting the terms and conditions of use of the AUTO VIAÇÕES to verify whether or not they authorize the transport of animals.

13.2 The USER must follow the standards established by the Ministry of Agriculture, Livestock and Supply and IBAMA (wild animals), as well as the specifications of each AUTO TRAVEL.

    INFORMATION UPDATE

14.1 SNOG reserves the right to improve the functionalities of the Services and implement new technologies. Therefore, the Terms of Use may be amended at any time, except in the case of legal prohibition, to include the implemented modifications. By continuing to use our Services after the Terms of Use have been changed, you agree to the changes made and in force at the time of access.

    GENERAL PROVISIONS15.1. The duly purchased ticket is irrevocable, in accordance with Articles 427 and 429 of the Civil Code of 2002, except in exceptional circumstances.15.2. When purchasing the ticket and making payment through SNOG channels, the USER declares to be aware of all Terms, receipt conditions and all information relating to the purchased product, in accordance with the provisions.15.3. SNOG will not be responsible for shipping costs if necessary.

15.4 The USER declares that they are aware that they do not have the right to demand the availability of SNOG channels, nor can they request compensation for damages due to possible instabilities or SNOG channels remaining temporarily off the air, whatever the reason.

15.5 SNOG mediates both intercity and interstate stretches, whose provisions will respect the peculiarities of its regulations.

15.6 When placing the order, the USER declares to be aware that the services contracted here are merely intermediation, research and reservation of bus tickets, whose transportation will be carried out by VIAÇÕES.

15.7 When placing the order, the CUSTOMER accepts and agrees with all TERMS OF USE and conditions established therein, as well as all policies and conditions presented by SNOG when providing its services.

15.8 In case of any problems with the products/services purchased, you can also contact SNOG through our call center.

15.9 SNOG will communicate 100% online, both on its WEBSITE, CHAT channels, social networks or by email. Therefore, it is the USER's obligation to keep their email address and telephone number always updated and their message box active, being fully responsible for reading the information sent, even those that have been sent to the SPAM box, and cannot claim ignorance or lack of knowledge. receipt of emails sent to him by
